Notify the ACPR of any problems encountered when using a dedicated interface (PSD2 API)
The second Payment Services Directive (PSD2) 2015/2366 of 25 November 2015 on payment services in the internal market updates the regulatory framework applicable to payments in Europe by increasing the level security of electronic payments and enhancing customer protection. This revised directive also introduces a framework for the provision of two new payment services: payment initiation services and account information services.
The PSD2 imposes a number of new requirements on Payment Service Providers (PSPs), in particular the requirement for new third-party payment service providers (AISPs, PISPs and PSPs issuing card-based payment instruments) to only access the payment account data of customers of Account Servicing Payment Service Providers (ASPSPs) through a secure communication channel (art. 98 of PSD2).
Delegated Regulation (EU) 2018/389 on strong customer authentication and common and secure open standards of communication (also referred to as the “security RTS”) provides for a number of notification obligations in respect of these account access interfaces, including the notification of any problems affecting dedicated interfaces (Article 33(3)).
In the case of France, this notification is sent by the payment service providers mentioned in Article 30 of the Security RTS (ASPSPs, AISPs, PISPs) to the ACPR (Autorité de contrôle prudentiel et de résolution – the French Prudential Supervision and Resolution Authority). This notification is made in line with the procedures set out in Instruction 2023-I-04 on information to be notified to the ACPR in the event of problems encountered in the course of using interfaces referred to as “API” that are provided by account servicing payment service providers.
In line with this instruction, the payment service providers referred to in Article 30 of Delegated Regulation (EU) 2018/389 shall notify the ACPR of any problem affecting dedicated interfaces, by filling out the questionnaire appended to this instruction (in French).
