Disciplinary proceedings 

When potential breaches of compliance are identified, for instance in the course of inspections, disciplinary proceedings may be initiated against any institution supervised by the ACPR.

The ACPR College refers the matter to the President of the Sanctions Committee, who appoints a rapporteur from among Committee members to investigate the case. Following the end of the investigation, all parties involved are summoned to a hearing, at the end of which the Committee deliberates on the grievances. If the ACPR deems these breach allegations substantiated, it imposes a sanction. The ruling of the Sanctions Committee may be appealed before the Conseil d’État (the French Council of State).

The Sanctions Committee: independence and impartiality

Within the ACPR, disciplinary powers are divided between the College, which is the prosecution body, and the Sanctions Committee, which is the judicial body. This separation of powers between the two bodies ensures the independence and impartiality of the Sanctions Committee. The Commission is composed of five other members and chaired by a Member of the Conseil d’État.
